LGU cracks down on Building Code violators

TABUK CITY, Kalinga – The City Building and Architectural Officer and the City Legal Officer are calling on all residents who have received notices for violation of the Building Code otherwise known as Presidential Dercree No. 1096 and likeswise for encroachment on roads right of way to rectify or comply otherwise the City Govenrment will hale them to court.

City Legal Officer Edward Kiser said that the LGU is now exercising political will in implementing the Building Code “for the interest of the public” informing that so far, his office and the CBAO have filed 13 cases one of which is currently being heard by the Municipal Trial Court.

“Next week, we are set to file 15 more cases against violators of the Building Code,” Kiser said.

City Building and Architecture Officer Ruby Peter Albert said that this marks the first time that the LGU files a case in court since the CBAO became fully operational in 2009.

Three of the cases including the one now being heard by the court are for occupation of a road right of way and the rest are for failure to secure Building Permits before starting the construction of their buildings.

Albert said that regarding the 15 against whom the the LGU filed the charges, the charges could still be withdrawn provided they comply.

‘To avoid surcharges and for their plans to be double checked to conform with standard designs, people who are about to construct buildings should obtain a Building Permit. There is no reason they should not comply because that is the law,” Albert stressed.
